245A.04 amended — CHOW moratorium exemption, attestation requirement, and inspection delegation added
A license issued through a change of ownership (245A.043) is now explicitly exempt from moratoriums under 245A.03 subd. 7 or 7a, as long as capacity and service scope do not increase. Providers electing publicly funded reimbursement for high-risk services (256B.044) must now submit a notarized attestation disclosing whether outside consultants helped prepare licensure, renewal, or ongoing compliance documentation. Subdivision 2a adds a formal framework allowing counties or local governments to conduct zoning and physical plant inspections under delegated authority for small residential programs, with coordination, frequency, and notification requirements.
