245A.04 Subd. 2a: Delegated inspection authority added for small residential programs

The law adds paragraphs (b) through (d) creating a framework under which the commissioner may delegate zoning and physical plant inspection authority to a county agency or local unit of government for existing residential programs serving six or fewer persons, at the county or local unit's request. A formal delegation document is required and must specify that the commissioner bears inspection costs and that no additional fees may be charged to the program, and the delegating county or local unit must give the program a copy of the delegation. Inspections are limited to no more than annually except for violation follow-ups, violation reports must reach the commissioner within ten business days, and the commissioner must review each delegating entity at least every four years for compliance. This section is effective January 1, 2027.
